Terms of Service

1. Acceptance

By creating an account or using PerceptaDent Passport, you agree to these Terms and to our Privacy Policy. If you use the platform on behalf of a clinic, you confirm you are authorized to bind that clinic.

2. The service

PerceptaDent Passport lets dental clinics record dental implants and post-operative radiographs and issue portable passports that patients can claim, view, share, and delete. PerceptaDent Passport is offered as a private beta, and we may change, improve, or discontinue features over time.

3. Your responsibilities

  • You are authorized to create and manage passports on behalf of your clinic.
  • You obtain each patient's consent before issuing their passport, and you record accurate information.
  • You keep your account credentials secure and are responsible for activity under your account.
  • You comply with applicable laws, including patient-privacy, medical-records, and any applicable state biometric or consumer-privacy regulations.

4. Patient data and HIPAA

Patient information is handled as described in our Privacy Policy. For clinics in the United States, PerceptaDent acts as a Business Associate under HIPAA, and processes Protected Health Information (“PHI”) on your clinic’s behalf under a Business Associate Agreement (“BAA”) executed directly with your clinic. Your clinic remains the Covered Entity responsible for obtaining any patient consent required by law. During the private beta, this BAA — rather than in-app per-patient consent toggles — is the basis on which we process patient data. Where these Terms and the BAA conflict with respect to PHI, the BAA controls.

5. De-identified data

As permitted by the BAA and by 45 CFR § 164.514, we may de-identify information in the platform so that it no longer identifies, and cannot reasonably be used to identify, any individual. Information de-identified in this way is not PHI and is not subject to the BAA.

We may retain and use de-identified implant records and radiographs to operate, secure, develop, and improve our products and services — including improving the accuracy of our implant-identification technology — and we may continue to do so after your account or the BAA ends. Free-text clinical notes are not used for this purpose. We maintain de-identified data in de-identified form, we do not attempt to re-identify it, and we require anyone to whom we provide it to do the same. We do not sell patient data, and we do not use patient data for advertising.

6. Acceptable use

You agree not to misuse the service, attempt to access data you are not authorized to access, disrupt the platform, attempt to re-identify de-identified data, or use the service for any unlawful purpose.

7. Changes to these terms

We may update these Terms as the service evolves. Material changes are published with a new version, and you may be prompted to review and accept the updated Terms before continuing.
